Collaboration – Clothing donation initiative

1. Organising company

The campaign “Clothing donation initiative” (the “Promotion”) is organised by VIA OUTLETS SEVILLA, S.L.U., with its registered office in Marratxí (Mallorca), Mallorca Fashion Outlet – Management Offices, Autopista Palma-Inca km 7.1, CP 07141, registered with the Commercial Registry of Mallorca under sheet PM-92144 / volume 2919 / page 49, and with Tax ID No. B91558940 (“VIA”).

2. Purpose of the Promotion

2.1. The Promotion will take place at Sevilla Fashion Outlet, San José de La Rinconada (Seville), Polígono Industrial Los Espartales, A-4 motorway, km 531, CP 41300 (the “Center”), from 12 October 2026 to 31 October 2026, both dates inclusive (the “Promotion Period”).

2.2. The Promotion is exclusively linked to the Sevilla Fashion Club loyalty programme (“Fashion Club”). During the Promotion Period, Fashion Club members who deliver one or more qualifying Bags in accordance with these Terms and Conditions will receive Fashion Club credit as described below.

2.3. Participation in the Promotion is free of charge.

3. Participants

3.1. Any natural person may participate provided that they: (i) are at least 18 years old; (ii) are a registered Fashion Club member; and (iii) participate as a private individual and not as part of a professional or business activity (the “Participant”).

3.2. Participation is personal and non-transferable.

4. Qualifying garments and bag requirements

4.1. Only fabric garments and coats will be accepted. Accessories, footwear and underwear are expressly excluded. VIA may reject any items that do not meet these requirements or whose condition may pose hygiene, safety or handling issues.

4.2. For the purposes of the Promotion, a “Bag” means a standard plastic bag measuring approximately 25 x 30 cm and containing at least five (5) qualifying garments. Any bag that does not meet both the size and minimum-content requirements will not generate Fashion Club credit.

4.3. Participation in the Promotion entails the Participant’s acceptance that TIC staff may inspect the contents of the Bag or Bags delivered in order to verify compliance with these Terms and Conditions.

5. Fashion Club credit

5.1. For each qualifying Bag delivered, the Participant will receive five euros (€5) in Fashion Club credit. A maximum of two (2) Bags per Participant will be accepted throughout the Promotion Period. Accordingly, each Participant may receive a maximum total of ten euros (€10) in Fashion Club credit under the Promotion.

5.2. The credit is personal and non-transferable, may not be exchanged for cash and will be subject to the operating and redemption conditions applicable to Fashion Club credit.

6. Participation procedure

6.1. To participate, the Fashion Club member must go to the Center’s Tourism and Information Point (“TIC”) during its opening hours and identify themselves by presenting or scanning their Fashion Club member QR code. The Participant must then deposit the Bag or Bags in the collection container located next to the TIC.

6.2. TIC staff will verify the Participant’s Fashion Club membership, the number of Bags delivered and, where reasonably possible, compliance with the participation requirements. Once verified, TIC staff will load the corresponding credit onto the Participant’s Fashion Club account.

6.3. VIA may request an official identification document solely to verify identity and prevent duplicate participation.

7. Availability and early termination

7.1. The Promotion and Fashion Club credit are subject to the budget allocated to the Promotion and the operational capacity of the collection service. Once the available budget or collection capacity has been reached, VIA may terminate the Promotion early, including before the end of the Promotion Period, without prior notice or any entitlement to compensation, without prejudice to rights already acquired by Participants who fulfilled all requirements before such termination.

8. Fraud and non-compliance

8.1. Any attempt to circumvent the Promotion rules, manipulate or reuse a member QR code, make duplicate claims, split or artificially repackage the same garments, provide false information or otherwise act fraudulently will result in exclusion from the Promotion.

8.2. If non-compliance is detected after the credit has been loaded, VIA may cancel or reverse the corresponding credit to the extent permitted by law.

9. Liability

9.1. VIA shall not be liable for interruptions, technical incidents, temporary system unavailability or the suspension, modification or cancellation of the Promotion where caused by force majeure, third-party acts or circumstances beyond VIA’s reasonable control.

9.2. Nothing in these Terms and Conditions excludes or limits any liability that cannot legally be excluded or limited.

10. Changes or cancellation

10.1. VIA may modify, suspend, extend or cancel the Promotion where there is justified cause, force majeure, a technical or operational incident, legal requirement, risk of fraud or another circumstance beyond VIA’s reasonable control that prevents the Promotion from being carried out as planned.

10.2. Any material change will be communicated through the channels used to advertise the Promotion and will not affect rights already acquired before the change was announced.

11. Data protection and privacy

11.1. VIA will process personal data as data controller to manage the Promotion, verify compliance with the participation requirements, load Fashion Club credit, prevent duplicate or fraudulent participation and handle claims or incidents. The data processed may include identification and contact details, Fashion Club identifiers, the number of Bags delivered and information necessary to document incidents or claims. Processing is based on the performance of the contractual relationship arising from participation and VIA’s legitimate interest in preventing fraud and duplicate participation.

11.2. Personal data may be processed by service providers acting as processors under VIA’s instructions and disclosed to competent authorities where legally required or where necessary for the establishment, exercise or defence of legal claims. Data will be retained for the duration of the Promotion and subsequently for the periods necessary to comply with legal obligations and address potential liabilities.

11.3. Participants may exercise their rights of access, rectification, erasure, objection, restriction and portability by emailing [email protected] with the subject “Ref: Clothing donation initiative”. They may also lodge a complaint with the Spanish Data Protection Agency.

12. Applicable legislation and jurisdiction

12.1. These Terms and Conditions shall be governed by Spanish law. Any dispute arising from or in connection with the Promotion shall be submitted to the competent courts and tribunals.
