CLOAKROOM SERVICE
These terms and conditions (“Terms”) govern our luggage cloakroom service (“Cloakroom Service”) provided by the Information Centre of Sevilla Fashion Outlet, (the “Centre”). Please read these Terms carefully before using the Cloakroom Service. By using the Cloakroom Service, you accept these Terms and signify your agreement to be bound by these Terms.
The Cloakroom Service at the Centre is provided to you by Via Outlets Sevilla, S.L.U., a private company with limited liability, having its registered office at Marratxí (Mallorca), Mallorca Fashion Outlet – Oficinas de Gerencia, Autopista Palma-Inca km 7.1, CP 07141, registered in the Commercial Registry of Mallorca (h: PM-92129 / t: 2918 / f: 188), under tax identification B86338977. References in these Terms to “we” or “us” are to this entity. By using the Cloakroom Service, you agree with our Privacy Policy.
CLOAKROOM SERVICE PURPOSE AND ADMISSIBLE ITEMS
The purpose of the Cloakroom Service is to storage luggage and baggage (“Stored Items”), only.
Information Centre which provides the Cloakroom Service accepts only standard luggage, baggage and other items which cannot injure, contaminate, or cause damage to persons, equipment or other Stored Items. Following items are expressly excluded from Cloakroom Service and cannot be accepted by us for Cloakroom Service:
any single item with value exceeding EUR 1,000;
items of excessive size 60x100x40cm and/or weight 20 kg;
dangerous materials, explosives, guns of any nature, army materials, poisons, chemicals, waste, hazardous substances and/or any items that include the aforementioned items;
animals, plants, food, liquids and fragile items, dirty or wet items;
personal identification documents, legal documents, valuables (for example but not exclusively jewellery, gold, silver, platinum, diamonds, furs, works of art etc.), payment cards, securities, electronic devices, cash.
We do not inspect the content of the Stored Items. You are responsible for ensuring that the Stored Items handed over to us to be stored in the Cloakroom Service are meeting the Terms hereof, specifically that they do not contain any of the excluded items. You are fully liable for any damages caused due to breach of your obligation under these Terms.
CLOAKROOM SERVICE OPERATION
The Cloakroom Service is being operated during the Centre operating hours only. In case that the Cloakroom Service is filled to its capacity, we are entitled to refuse storage of any other items.
While handing over your Stored Items to us, you are requested to fill in selected personal data on the luggage storage form, i.e. your name, Stored Items, country, phone number and delivery and pick up time of the Stored Items. While collecting your Stored Items from the Storage Room, you will be required to present your identification document to evidence your identity as well as the Cloakroom Service ticket received from us.
You are obliged to collect your Stored Items on the same day and are obliged to present yourself at the Information Centre in a timely manner, well in advance of the Centre closing times, i.e. at 21:45 p.m. at the latest. You are required to check the Stored Items upon collecting immediately and inform us about the potential ascertained damage; later complaints will not be taken into account.
UNCOLLECTED ITEMS
Should you fail to timely collect your Stored Items, we will proceed in line with the applicable legal regulation and consider your Stored Items as lost items.
All lost items are deposited in the Sevilla Fashion Outlet for 3 calendar days from their acceptance in a lockable room. If the owner of the lost item who makes himself or herself known by phone or e-mail by the end of the deposition period and requests extension of the deposition period in the Sevilla Fashion Outlet, the deposition period shall be extended on the basis of such request by 10 calendar days at the maximum. If the lost item is not retrieved within the given period, the Centre shall determine its destination and the client will not be entitled to claim anything.
PERSONAL DATA PROTECTION
We process the information you provide us with in order to provide the requested service or invoice you. The data provided will be kept as long as we maintain our commercial relationship or within the necessary period to comply with the legal obligations and attend possible responsibilities that may arise due to the compliance of the requested data purpose. The data will not be transferred to third parties except in cases where there is a legal obligation. You have the right to obtain information about whether we are treating your personal data, so you can exercise your rights of access, rectification, deletion and portability of data and opposition and limitation to your treatment before us at Marratxí (Mallorca), Mallorca Fashion Outlet – Oficinas de Gerencia, Autopista Palma-Inca km 7.1, CP 07141 or at the email address [email protected], attaching a copy of your ID card or equivalent document. Likewise, and especially if you consider that you have not obtained full satisfaction in the exercise of your rights, you may file a claim with the national control authority by contacting the Spanish Data Protection Agency, C/ Jorge Juan, 6 – 28001. DAMAGE TO STORED ITEMS
Should you ascertain any damage to your Stored Items at the moment of their pickup, you must immediately report this to the Information Centre staff and fill in a claims form.
LIABILITY
We will not have access to information regarding the value of your luggage and will therefore a limit of our liability for loss or direct damage of your luggage to the amount of EUR 1,000 per item and a maximum of EUR 2,500 in total. We will only be responsible for loss or damage to your luggage where such loss or damage is directly attributable to our actions and/or omissions. Your statutory rights are not affected.
Should we ascertain that your Stored Items have caused damage to other Stored Items, property or our employees, you and we will record the incident in a report before the Stored Items are handed over back to you. Based on the report, you are obliged to pay the damages caused by your Stored Items. If you refuse to record the incident, we are entitled to refuse to hand over the Stored Items to you.
GOVERNING LAW AND JURISDICTION
The Terms are governed by Spanish law and are subject to the exclusive jurisdiction of the courts of the Seville.
