ANIMAL ACCESS REGULATIONS
RULES GOVERNING THE ACCESS AND CIRCULATION OF ANIMAL COMPANIONS AT
THE SEVILLA FASHION OUTLET
A) PURPOSE:
1. These rules govern the terms on which pets and other animal companions are permitted to enter and circulate through the Sevilla Fashion Outlet (the “Shopping Centre”), and the obligations and responsibilities of their owners, handlers, and/or those responsible for these pets upon entering the Shopping Centre, in accordance with the national Law 7/2023, of 28 March, on the protection of animal rights and welfare, and with the Andalusian Law 11/2003 of 24 November, on the protection of animals, and the legislation governing pet access to public premises and establishments in force at any given time.
2. For the purposes of these rules, animal companions (or pets) are considered those having such consideration in accordance with the legislation mentioned in paragraph 1 above, or those that may be considered as such by the regulation at any time, in accordance with the lists that are expected to be approved in the future.
3. These rules will be displayed at all entrances to the Shopping Centre, access to which will amount to unqualified acceptance by the owners, handlers, and/or those responsible for the pets whose entry is regulated in accordance with the following.
B) PET ACCESS AND PROHIBITIONS:
4. Dogs and cats (“Permitted Animals”) are permitted to enter and circulate through the Shopping Centre in accordance with these rules. Therefore, the entry and circulation of companion animals other than those, specifically reptiles, arachnids, birds, guinea pigs, and rodents, among others, is prohibited.
5. If requested, before accessing the Shopping Centre, the handler must provide Shopping Centre Management or its representatives with the animal’s identification data or that of its owner, handler, and/or the individual responsible, according to the form provided for these purposes.
6. In general, Permitted Animals will be allowed to access and circulate through the Shopping Centre’s common areas and zones. This rule does not apply to the interior of the Shopping Centre’s units, each of which will determine their own pet admission policies. When access to Permitted Animals is refused, the unit must indicate it by displaying a badge visible from the exterior.
7. For reasons of safety, health, and hygiene, entry and circulation is strictly prohibited for Permitted Animals in the following cases:
a) dogs that have displayed aggression toward people;
b) In establishments dedicated to the manufacture, handling, storage, transport, or sale of food products. However, in the case of restaurants, bars, and other premises where food and drinks are consumed, each establishment could decide about such admission (which could only occur in areas non dedicated to the preparation, storage or handling or food). When it is not permitted, the establishment must indicate it by displaying a badge visible from the exterior; or
c) That are visibly debilitated, sick, that do not display the proper hygiene or behaviour, or that appear potentially aggressive, at the discretion of the Shopping Centre.
8. For security reasons and to ensure normal operations, the Shopping Centre reserves the right to:
a) Refuse access to Permitted Animals that, in the opinion of Management or its representatives, may pose a risk or danger to people, things, or other animals, or that may jeopardise the normal functioning of the Shopping Centre, and the comfort and safety of visitors, employees, and other Permitted Animals; or
b) Remove the animal from the Shopping Centre when, in the opinion of Management or its representatives, situations occur that affect/may affect the safety of people or things, or the functioning of the Shopping Centre, or when these rules are not complied with.
C) OBLIGATIONS AND/OR RESPONSIBILITIES OF PET HANDLERS:
9. Permitted Animals will only be allowed to access and circulate (common areas and participating establishments) when accompanied by a person capable of controlling the animal, who will be responsible for their behaviour and liable for any potential damage or injury caused.
10. The owners, handlers, and/or those responsible for the Permitted Animals must keep them on a non-extensible leash no longer than 1 meter or hold them in a closed pet carrier. In the case of dangerous or potentially dangerous dogs (“PDDs”) in accordance with the regulations governing these types of animals (among others, the following breeds, mixes, or hybrids: Pit Bull Terrier, Staffodshire Bull Terrier, American Staffordshire Terrier, Rottweiler, Dogo Argentino, Fila Brasileiro, Tosa Inu, Akita Inu and Doberman) they must also circulate equipped with a muzzle appropriate to their species and be driven by people of legal age. Only one potentially dangerous dog may be walked per person.
11. The owners, handlers, and/or those responsible for the Permitted Animals must carry with them at all times the material needed to collect and remove excrement and, if necessary, wipes to clean areas soiled by the animal.
The owners, handlers, and/or those responsible for the Permitted Animals will be required to: 1) collect any droppings produced by the animal and deposit them in the bins designed for this purpose in the common areas; and 2) clean the areas and/or elements soiled by the animal.
12. The owners, handlers, and/or those responsible for the Permitted Animals must comply at all times with the law governing pet ownership, specifically as it applies to registration, identification, vaccination, transport, care, watchfulness, supervision, health, hygiene, and safety.
13. Under no circumstance will the Shopping Centre be liable for complying with vaccination, electronic identification, or deworming obligations in relation to the Permitted Animals. This is the owner, handler, and/or individual responsible for the pet’s sole responsibility.
14. The owners, handlers, and/or those responsible for the Permitted Animals will not hold the Shopping Centre liable (including pecuniary and non-pecuniary losses) for any event/act executed by the Shopping Centre that harms or may harm them, their companions, Shopping Centre users or visitors, and/or the Permitted Animal.
D) EXCLUSIONS:
15. Assistance dogs and those belonging to the Armed Forces or Security Forces and Corps are exempt from the restrictions and/or prohibitions on access and circulation cited in this document, without prejudice to compliance with the remaining obligations and/or responsibilities in these rules and the law as it stands at any given time, and paragraph 8 of this Regulation for those aspects governed in those paragraphs.
