GIFT WITH PURCHASE CAMPAING TERMS AND CONDITIONS
1. PROMOTION DESCRIPTION
The campaign “GIFT WITH PURCHASE” (the “Promotion”) is organised by VIA OUTLETS SEVILLA, S.L.U., with its registered office in Marratxí (Mallorca), Mallorca Fashion Outlet – Management Offices, Autopista Palma-Inca km 7.1, CP 07141, registered with the Commercial Registry of Mallorca under sheet PM-92144 / volume 2919 / page 49, and with Tax ID No. B91558940 (“VIA”).
The Promotion takes place at Sevilla Fashion Outlet, San José de La Rinconada (Sevilla), polígono industrial Los Espartales, autovía A-4, km. 531, CP 41300 (the “Center”) and starts on 1 July 2026 and closes on 14 August 2026, both dates inclusive (the “Promotion Period”). Notwithstanding the foregoing Gift with Purchase (as this term is defined below) are limited and subject to the stock available for this Promotion. Accordingly, once such limit has been reached, VIA reserves the right to terminate the Promotion early, including prior to the end date of the Promotion Period, without prior notice and without any entitlement to compensation for participants.
The Promotion consists of awarding one (1) gift with purchase (the “Gift with Purchase”) to Sevilla Fashion Club loyalty programme (the “Fashion Club”) members, or VIP Day Pass holders or Center’s guests who, during the Promotion Period, make purchases for an amount equal to or greater than 250 € in stores within the Centre participating in the Fashion Club and/or the VIP Day Pass program, using the Fashion Club member QR code or the VIP Day Pass QR code at the time of purchase.
The Gift With Purchase may be a towel, a beach bag, or a pareo, at the Participant’s choice and subject to availability. A total of 200 towels, 100 pareos, and 200 beach bags will be distributed.
2. PARTICIPANTS
Any natural person may participate in the Promotion, provided that they: (i) are at least 18 years of age; (ii) are Fashion Club members or a VIP Day Pass holder; and (iii) participate in the Promotion as a private individual and not as part of their self-employed professional or commercial activities(hereinafter, the “Participant”).
Participation is personal and limited to three (3) Gifts with Purchase per Participant and day throughout the Promotion Period.
For the avoidance of doubt, the Promotion shall only be active during the Promotion Period specified in these Terms and Conditions. Purchases made outside the Promotion Period, purchases that are returned, cancelled, or refunded, and purchases of gift cards or equivalent instruments shall not be taken into account. The qualifying spend shall be calculated on the amount effectively paid by the Participant after discounts, vouchers, returns or refunds.
3. PRIZE
The prize that may be awarded under this Promotion is a Gift with Purchase for purchases made in participating Fashion Club Centre stores for a total amount equal to or greater than 250 €. Specifically, up to three (3) Gifts with Purchase may be awarded per Participant per day throughout the Promotion Period.
The prize is as described in the preceding paragraphs and does not extend to any other concept not expressly specified therein.
The prize is personal and non-transferable. It may not be exchanged in any way, including for its monetary value. Under no circumstances may the prize be redeemed for cash.
In compliance with applicable legislation, where relevant, VIA shall apply the corresponding withholding and make the relevant payment on account of Personal Income Tax in relation to the prize awarded to the winner and shall report such prizes in the relevant tax filings. Any tax implications arising from the receipt or use of the prize shall be borne by the winner, and VIA shall be held harmless from any liability in this regard to the extent permitted by law.
4. PRIZE REDEMPTION
Fashion Club Members
If, during the Promotion Period, a Participant who is a member of the Fashion Club makes purchases in stores within the Center participating in Fashion Club for a total amount equal to or greater than 250 €, the Fashion Club member must ensure that their Fashion Club member QR Code is scanned at the relevant store within the Center at the time of purchase. Once VIA’s systems verify fulfilment of the Promotion requirements, the Fashion Club member shall receive an email notification informing them that they may go to the Tourism and Information Point of the Center (“TIC”) to collect the Gift with Purchase by presenting their Fashion Club member QR Code and, where requested, by presenting an official identity document solely to prevent duplicate participation.
In the event that the Participant has not enabled the receipt of promotional communications from VIA, the Participant shall, once they have verified that they have reached the aforementioned amount of 250 €, go to the TIC to collect the Gift with Purchase by presenting their Fashion Club member QR Code. VIA shall not accept any QR codes that have not been properly scanned at establishments participating in the Fashion Club, and the Participant shall be excluded from this Promotion where the requirements cannot be verified.
The Participant’s identification must match the name used to register for the Fashion Club; otherwise, the Participant will be immediately disqualified.
VIP Day Pass holders
If, during the Promotion Period, a Participant who is a VIP Day Pass holder makes purchases for a total amount equal to or greater than 250 € in stores within the Center participating in Fashion Club, the Participant shall, once they have verified that they have reached the aforementioned amount of 250 €, go to the TIC to collect the Gift with Purchase by presenting their VIP Day Pass QR Code. VIA shall not accept any QR codes that have not been properly scanned at the Center’s establishments, and the Participant shall be excluded from this Promotion. TIC staff may require the presentation of an official identity document solely to prevent duplicate participation.
The Participant must present their valid VIP Day Pass at the TIC; otherwise, the Participant will be immediately disqualified.
Prize redemption period
The Participant must collect their Gift with Purchase by 14 August 2026 during the TIC’s opening hours and subject to prior verification of compliance with these Terms and Conditions. If the Gift with Purchase is not collected by this date, it will be considered a refusal.
5. FRAUD
Any attempt at fraud will result in the Participant’s immediate exclusion from the Promotion. Fraudulent conduct includes, without limitation, providing false or inaccurate identification data; manipulating QR Codes, VIP Day Passes or registration systems. VIA may carry out proportionate checks and retain the minimum information necessary to document the incident and defend its rights.
6. NON-COMPLIANCE
If a Participant does not comply with the criteria set out in these Terms and Conditions, the Gift with Purchase shall not be awarded and shall be retained by VIA.
7. LIABILITY
VIA shall not be liable for interruptions, technical incidents, errors in communications, temporary unavailability of systems or cancellation, suspension or modification of the Promotion when caused by force majeure, third-party acts or circumstances beyond VIA’s reasonable control. Nothing in these Terms and Conditions excludes or limits VIA’s liability for wilful misconduct, gross negligence, death or personal injury, consumer rights that cannot be waived, or any other liability that cannot legally be excluded.
Each Participant must take all necessary measures to protect their own data and/or the software of their electronic device, computer and/or website from any potential attacks.
Participation in the Promotion is the responsibility of each Participant, who must ensure that the information, QR Codes or VIP Day Passes submitted are accurate, valid and sufficient to evidence compliance with the Promotion requirements. VIA shall not be liable for the Participant’s failure to submit the required evidence or for errors attributable to the Participant, without prejudice to the rights recognized by mandatory consumer legislation.
VIA may, in good faith, verify whether Participants have complied with these Terms and Conditions, particularly with regard to the disqualification of any Participant who has abused the Promotion or attempted to circumvent its requirements.
8. CHANGES AND/OR CANCELLATION OF THE PROMOTION
VIA reserves the right to modify, suspend, extend or cancel the Promotion where there is a justified reason, force majeure, a technical or operational incident, legal requirement, fraud risk, or any other circumstance beyond VIA’s reasonable control that prevents the Promotion from being carried out as planned. Any material change shall be communicated through the same channels used to advertise the Promotion and shall not affect rights already acquired by Participants who fulfilled the requirements before the change was announced.
In particular, and as set out in Section 1 of these Terms and Conditions, the stock of towels, pareos and beach bags allocated as Gift with Purchase within the framework of this Promotion is limited. Accordingly, once such limit has been reached, VIA reserves the right to terminate the Promotion early, including prior to the end date of the Promotion Period, without prior notice and without any entitlement to compensation for participants.
VIA shall not be held liable if the Promotion has to be interrupted, delayed or even cancelled due to causes beyond its control.
Any matter not expressly provided for in these Terms and Conditions shall be resolved by VIA in good faith, in accordance with the purpose of the Promotion, the information provided to Participants and applicable law, and without prejudice to the rights recognised to consumers and users under mandatory legislation.
9. DATA PROTECTION AND PRIVACY
VIA shall process personal data as a data controller for the purpose of carrying out and managing the Promotion, verifying compliance with the participation requirements, delivering the Gift with Purchase, communicating information related to the Promotion, preventing and detecting duplicate or fraudulent participations, as well as handling claims or incidents. Such processing is necessary and justified on the basis of the performance of the contract arising from the Participant’s participation in the Promotion and VIA’s legitimate interest in preventing fraud, duplicate entries.
The categories of data processed may include identification and contact details, Fashion Club or VIP Day Pass identifiers, receipt numbers and purchase information necessary to verify compliance with the requirements.
No disclosures of personal data are envisaged, except to the Center’s brand partners for the verification of purchase validity or potential fraud, and to competent authorities where there is a legal obligation or where necessary for the establishment, exercise or defence of legal claims. Additionally, the data may be processed by providers acting as data processors and following VIA’s instructions in the context of the provision of services. No international transfers of data are envisaged.
The data shall be processed by VIA while the Promotion remains open for participation. Once all prizes have been awarded, the data shall be retained for the period necessary to comply with VIA’s legal obligations, including the applicable limitation periods for any actions arising from the Promotion.
Each Participant has the right of access, rectification, erasure, objection, restriction of processing and data portability, which may be exercised by sending an email to [email protected], indicating in the subject line: “Ref: Gift with Purchase Promotion.” Participants may also lodge a complaint with the Spanish Data Protection Agency if they consider that the processing of their data breaches these Terms and Conditions or applicable legislation.
We are committed to protecting the Participant’s privacy and only use personal data in accordance with applicable data protection laws.
10. APPLICABLE LEGISLATION AND JURISDICTION
These Terms and Conditions shall be governed by Spanish law. Any dispute arising from or in connection with the Promotion shall be submitted to the competent courts and tribunals.
